 CHAIRMAN MILLER opened the hearing on  SB 46  (PROSECUTE JUVENILE AS          
 ADULT IN DIST. CT.).                                                          
                                                                               
 JOE AMBROSE, staff to Senator Robin Taylor who is prime sponsor of            
 SB 46, stated Senator Taylor was asking that the committee consider           
 a proposed Rules CS.  The following language was added on page 2,             
 line 27 - 30 to clear up intent of a provision added in the Senate            
 Finance Committee:  " however, unless there is lawful reason for             
 further detention, a person who is under the age of 18 and who has            
 been arrested for violating AS 04.16.050 shall be cited for the               
 offense and released to the person's parent, guardian, or legal               
 custodian."                                                                  
                                                                               
 Mr. Ambrose explained that the Finance Committee added "minor                 
 consuming" to the list of reasons why an officer can make a                   
 warrantless arrest.  Senator Taylor wants to be sure that this                
 intent is not punitive, that it is protective.  If a minor is                 
 arrested for minor consuming without a warrant the job of the                 
 police is to cite that individual and then get the individual into            
 the care of a responsible adult.                                              
                                                                               
 SENATOR SALO moved that CSSB 46(RLS) be adopted.  Hearing no                  
 objection, the Chairman stated the committee substitute was                   
 adopted.                                                                      
                                                                               
 SENATOR SHARP moved and asked unanimous consent that SB 46 be                 
 approved for calendaring.  Hearing no objection, it was so ordered.
